In Kentucky there are time limitations known as the Statute of Limitations in Kentucky. For a normal personal injury suit, the statute of limitation in Kentucky is one year. In a motor vehicle accident or a tractor trailer, the statute of limitations is two years from the date of the accident or two years from the date of the last payment that was made. Additionally, in the event that you are under the age of 18, the statute of limitations does not begin to run until you reach the age of 18. Furthermore, if your loved one or family member has died as a result of the catastrophic injury, you have one year from the date of death to have a personal administrator appointed. You then have one year from that date to file your lawsuit. For example, if a loved one dies as a result of the catastrophic injury on January 1st of 2015, you have until January 1st of 2016 to have a personal representative appointed, and January 1st of 2017 to file your lawsuit.
