In Kentucky, damages are determined, not only by statute, but common law. In Kentucky, there are two types of damages, compensatory damages and punitive damages. Compensatory damages are those damages that are meant to put the person in the place they were before the accident. They cover such things as, medical bills, pain and suffering, lost wages and, if you were working at the time of the accident, and are unable to go back to work, they will also cover future lost wages. Sometimes when you lose a loved one, and their services, and loss of love and affection, are also included in compensatory damages. Punitive damages are those damages that are meant to punish and deter harmful conduct in the future. In addition to the compensatory damages, sometimes judges will award punitive damages, to make sure the conduct that occurred does not happen again.
