The statute of limitations in a brain injury case is like any other personal injury case in Kentucky. The statute of limitations begins to run one year from the date of the accident or the injury. If the accident or injury is to a minor, the statute of limitations begins to run once the minor turns eighteen years of age. Thus the one year statute of limitations would expire on the nineteenth birthday of that child.
