Who can bring a claim on behalf of a family member who dies as a result of a defective drug or medical device injury?
The Kentucky Wrongful Death Statute determines who benefits and recovers under a wrongful death claim. However, the Kentucky Wrongful Death Statute does not determine who can bring the lawsuit on behalf of a deceased family member. What we see if most cases that is brought by a parent, a sibling, a husband or a wife, or sometimes even a close relative or a friend, but the statute does not set out who necessarily has to bring the lawsuit.
