Punitive damages are very limited in a Kentucky defective products case. In order to recover punitive damages, you must prove that the conduct of the product manufacturer was oppressive or fraudulent. It also must be done by clear and convincing evidence. It is a very difficult standard but we have been very successful in obtaining punitive damages in many products liability cases here in Kentucky.
