If I am seriously injured by a product that is more than two years old, do I still have a product liability case?
The statute of limitations does not begin to run in a products liability case until a person is injured by the product. A product can be as old as five or ten years old and you still have the right to file a lawsuit. It may also be extended by a Kentucky rule called the discovery rule. In those cases, the statute of limitations does not begin to run until you discover that you were injured by the product or a period of time where you should have discovered that that product caused some type of injury to you or a loved one.
